Service Terms for Residential Customers

If you are a residential customer receiving waste service from Gig Waste Services, LLC (Gig Waste Services), without a signed customer service agreement, your services are provided pursuant to the terms on your invoice and the terms disclosed on this page (you are an “Invoice-to-Invoice Customer”).

Responsible Party

All waste services are managed and performed, by Gig Waste Services, LLC.  Accordingly, all obligations to you, including providing quality service rests with Gig Waste Services, LLC. Any claims you may have relating to your service may be brought only against this entity.  Gig Waste Services may employ third parties to perform billing services.  If so, the third party will be disclosed on the service rate sheet.  If a third party is utilized, they have the right to charge a reasonable service fee for their services.  This service fee will be listed as a separate line item on your bill.

Term, Billing, Payments, and Fees
The term of service for Invoice-to-Invoice Customers is the equivalent to your billing period. For example, if you are billed quarterly for your service, your term of service is quarterly; if you are billed monthly, your term of service is monthly. Each invoice represents an offer to you to continue receiving waste services for a further term at the rates specified in that invoice. By paying the invoice, you agree to the terms set forth on the invoice. Your payment is due to Gig Waste Services by the dates shown on your invoice.   Failure to pay your invoice can result in late fees and possible service interruption charges.  More information on rates (including rate increases) may be round on our "Understanding our Rates, Charges, and Fees" disclosure.
Payment Methods

Gig Waste Services, LLC only provides for electronic billing and payment.

  • As part of service signup, you will need to provide a credit card account or bank account information.  We will automatically draft this account each month.
  • We will provide an electronic copy of your invoice and receipt.  These will be emailed to you and will also be available in your customer portal area.
  • We do not accept cash or checks.
  • Late charges may be added if your account is not paid by the due date.
Service Changes and Rate Adjustments

If you request a service modification during any Term, those charges will be reflected on your next invoice for the following Term. Gig Waste Services reserves the right to change or increase your rates, charges, and fees at its discretion with advanced notice to you.  This notice will be in the form of a change on your invoice or these service terms. By paying an invoice or continuing services after a rate, charge, term or condition, or fee change, you are agreeing to such change.  More information on rates (including rate increases) may be round on our "Understanding our Rates, Charges, and Fees" disclosure.

The Garbage Tote

During your application, you will be asked to enter payment information for the garbage collection service.  Upon receiving payment information, Gig Waste Services, LLC will schedule the delivery of a garbage tote (wheeled garbage container).  This garbage tote is loaned to you for the duration of your service.   By maintaining service with Gig Waste Services, LLC, you agree that:

  • The garbage tote remains the properly of Gig Waste Services, LLC.
  • Only garbage contained in your Gig Waste Services tote is eligible for pickup.
  • If the tote becomes damaged or lost, Gig Waste Services, LLC will charge you $100 for a replacement.
  • Upon cancellation of the service, you will make the tote available to us for retrieval. 
Cancellation
  • You have a right to rescind your initial order for service within 3 days of your order without incurring any charges by emailing Gig Waste Services at [email protected]Requests for cancellation of service cannot be made phone.  Any prepaid charges will be refunded to you less any amounts for services rendered. 
  • You may also cancel your services at any other time by emailing Gig Waste Services at [email protected]Requests for cancellation of service cannot be made phone. Please note that advanced notice is required to cancel services, so your cancellation will be effective as of the last day of the current term of service in which you cancel. For example, if you cancel service on March 15, Gig Waste Services will process your cancellation to be effective on the last day of your current term of service period.  We require at least 2 business days of notice to process a cancellation request.
  • Your garbage tote is owned by Gig Waste Services, LLC. If you elect to cancel service, you must make your garbage tote available for pickup by our service team.  We will send you an email outlining the day we intend to pick up the garbage tote.  You must leave the tote out near the end of your driveway on that date.
  • Garbage totes that are not returned in good condition will be billed at $100.  You specifically agree that we may charge your normal payment account for any missing or damaged garbage tote.

Dispute Resolution - Agreement to Arbitrate and Class Action Waiver
    READ THIS PROVISION CAREFULLY AS IT WILL HAVE A SUBSTANTIAL IMPACT ON HOW LEGAL CLAIMS WE HAVE AGAINST EACH OTHER ARE RESOLVED. Except for claims relating to non-payment, any and all other disputes or claims between you and Gig Waste Services, LLC, whether such claim or dispute arises in contract, tort, fraud, under statutory or common law, or otherwise (“Claim”), will be submitted to mandatory, binding arbitration before the American Arbitration Association (“AAA”) in the state of your residence before one arbitrator. The AAA will conduct any arbitration pursuant to this agreement under the Consumer Arbitration Rules in effect at the time the arbitration is commenced. For explanation of those rules, please consult the AAA website at www.ADR.org. The decision of any such arbitrator shall be binding and conclusive, and the arbitrator may not consolidate more than one person’s Claims and may not preside over any form of a representative or class proceeding. Instead of arbitration, you may sue our operating subsidiary that provides your service in small claims court if you meet the court’s requirements. For any Claim subject to arbitration, small claims court, or otherwise, pursuant to these terms and conditions, no party will have the right to participate in a class action in court or in arbitration or join or consolidate a Claim with claims of any other person.
